  • What is Office Action

Once an Applicant files a trademark application, it will be searched and examined by the Trade Mark Office. If there are any deficiencies in the application and/or any objections to the mark according to the local trade mark law, an Office Action (aka Examination Report / Opinion / Refusal / Rejection) will be issued to reject its registration.

 

If the applicant is not satisfied with the grounds for refusal, who may make amendments, written response, or appeal within a specified period.

There are several possible grounds for trademark registration refusal, which mainly include:

  1. Lack of distinctness (merely descriptive);

  2. Likelihood of confusion (identical or confusingly similar to one or more prior registered mark in respect of identical or similar goods/services in the same or similar class); or

  3. Misleading description / deceptively mis-descriptive;

  4. Other local special regulations/rules.
